P.L. 91-596 Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of chemical exposures: a) I-95 southbound middle lane, north of Shop Road, Eulonia, Ga. - The Street Operator, who works on and around the Paver, was exposed to excessive Asphalt (Petroleum) Fume, during paving work that took place, on or about 07/12/01. The 8-hour Time Weighted Average exposure level to Asphalt (Petroleum) Fume was found to be 5.4 mg/m3, (6.1141 mg/m3 was found during a 425 minute sample). b) I-95 southbound middle lane, north of Shop Road, Eulonia, Ga. - The Paver Operator was exposed to excessive Asphalt (Petroleum) Fume, during paving work that took place, on or about 07/12/01. The 8-hour Time Weighted Average exposure level to Asphalt (Petroleum) Fume was found to be 4.897 mg/m3, (5.4410 mg/m3 was found during a 432 minute sample). c) I-95 southbound middle lane, north of Shop Road, Eulonia, Ga. - The Shuttle Buggy Operator was exposed to excessive Asphalt (Petroleum) Fume, during paving work that took place, on or about 07/12/01. The 8-hour Time Weighted Average exposure level to Asphalt (Petroleum) Fume was found to be 1.875 mg/m3, (4.5 mg/m3 was found during a 200 minute sample). Among other methods, one feasible and acceptable method to correct this hazard is to: 1. Install feasible engineering controls on the Paver and Shuttle Buggy equipment that captures and/or dilutes the Asphalt (Petroleum) Fume that is created during paving. 2. Utilize administrative controls that lower exposure levels by rotating employees that work the Street Operator, Paver Operator, and Shuttle Buggy Operator positions with other work positions that have less exposure to the Asphalt (Petroleum) Fume.
