P.L. 91-596 Section 5(a)(1) of the Occupational Safety and Health Act of
1970: The employer
did not furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that an
employee was exposed to steam and condensate that caused serious burns
following the
catastrophic failure of a pressure vessel.
a)  On the 2nd floor of the #4 powerhouse - The feedwater stage heater, a
shell and tube heat
exchanger containing tubes of water under 1800 psi pressure at a
temperature of 270 degrees
fahrenheit had not been inspected by an NBIC (National Board of Boiler and
Pressure Vessel
Inspectors) commissioned inspector.  Deteriorated tubes allowed leakage of
the high pressure
water into the shell (rated for 200 psi) which did not have a pressure
relieving device.
Overpressurization caused the vessel to rupture, spewing steam and
condensate on an employee,
on or about 01/22/02.
Among other methods, feasible and acceptable means of abatement are a) to
have a
commissioned inspector evaluate the condition of the vessel.  NBIC, Part
RB-3237 requires the
maximum period between internal inspections or a complete on-stream
evaluation of the vessel
of not more than one-half of the estimated remaining life of the vessel or
ten years, whichever
is less; and b) to install a safety relief device on the pressure vessel.
ASME Boiler & Pressure
Vessel Code, Section VIII, Division I, paragraph UG-125 (a) requires that
all pressure vessels
be provided with protective devices in accordance with the requirements of
UG-125 through UG-
136.
