P.L. 91-596 Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of getting thrown out of the operators seat and being crushed by the industrial lift truck. a) Shop area - Employees were operating a Clark industrial forklift truck that was not equipped or retro-fitted with seatbelts. This was exposing the operators to struck-by/crushed-by hazards, should the forklift be accidentally tipped over, that could result in fatal injuries when their upper body parts were struck/crushed by the forklift truck's overhead protection device as they were thrown out of the operator seat. On or about 03/12/02. Other feasible and acceptable abatement methods to correct this hazard are: Install seatbelts on the industrial trucks and require employees to wear the seatbelts.
