P.L. 91-596 Section 5(a)(1) of the Occupational Safety and Health Act of
1970: The employer
did not furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to being struck by automotive lifts or vehicles
raised on them that
unexpectedly drop:
a) Throughout the Repair Shop - The employer did not provide sufficient
lift training, operating
instructions, and basic safety information.  Also, the employer did not
perform periodic lift
inspections for employees who were required to use automotive lifts.
Consequently, employees
worked under lifts that were not maintained in safe condition, including
the #2 in-ground single
post swing rail Gilbarco lift (located along the west wall, second lift
from the south end of the
repair shop) which was leaking hydraulic fluid at the seal; the #15
in-ground single post swing
rail Gilbarco lift (located along the east wall, lift closest to the south
end
of the repair shop)
which was missing the over-travel stops that keep the telescoping arms on
the swing rails from
sliding off; the #14 in-ground single post swing rail Gilbarco lift
(located along the west wall,
second lift from the south end of the repair shop) which had a bent swing
rail arm and a broken
mechanical locking device; the #7 two post swing rail Gilbarco lift
(located adjacent to the parts
washer) which had a broken locking device; and the #9 single post swing
rail Gilbarco lift
(located on the east side of the center wall, third lift from the south
end of the repair shop)
which had a broken mechanical locking device.
Feasible and acceptable abatement methods to correct this hazard are 1) to
provide training in
accordance with ANSI/ALI B153.1-1990, Section 7.2.2, 2) to provide lift
operating instructions
in accordance ANSI/ALI B153.1-1990, Section 7.2.1, and 3) establish a
periodic lift inspection
procedure in accordance with ANSI/ALI B153.1-1990, Section 7.3.ion
