Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees exposed to the hazard of being infected with Mycobacterium tuberculosis through unprotected contact with patients who were infectious or suspected to be infectious with tuberculosis in that: At the Hospital, employees who conduct high hazard procedures including, but not limited to bronchoscopy, sputum induction, endotrachael intubation and suctioning procedures, endoscopic procedures and aerosolized medication treatment on patient(s) with suspected or confirmed infectious TB disease were not given periodic PPD- tuberculin skin tests, every 3-6 months, exposing them to the hazards of being infected with M. tuberculosis. Feasible and useful abatement methods for reducing this hazard, as recommended by CDC, include but are not limited to periodic PPD skin testing shall be conducted every three (3) months for workers in high risk categories, every six (6) months for workers in intermediate risk categories, and annually for low risk personnel. Workers with a documented positive TB skin test who have received treatment for disease or preventive therapy for infection are exempt from the TB skin test but must be informed periodically about the symptoms of TB and the need for immediate evaluation of any pulmonary symptoms of TB disease have developed.
