Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: At the Huntsville Elementary construction site, an employee operating a Model DL6H GEHLExtendable Boom Forklift (Serial No. 6H40J0820224) to carry pallets of stone was exposed to crushing injuries due to the lack of use of a seat belt.
