General-duty citation text
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall hazard: a) Manufacturing Area: Employee was raised on the forks of a powered industrial truck approximately 7 feet to enable him to climb onto a crate being assembled. The employee did not use an appropriate safety platform or other fall protection and was exposed to a fall hazard of 7 feet to the concrete floor below. Violation observed on or about 8/1/2000 ABATEMENT NOTE: "Among other methods, one feasible and acceptable abatement method to correct this hazard is 1) Utilize only platforms designed for use in elevating personnel with forklifts. These platforms must meet the requirements set forth in ANSI/ASME B56.1- 1993, Safety Standard for Low Lift and High Lift Trucks. 2) Train employees to use ladders to ascend to the top of the crates and use harnesses clipped to the steel beams above. This violation requires both certification and documentation as appropriate proof of abatement within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.
