Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that the truck driver and co-worker/rider were exposed to the truck driver's affected performance, who was under the influence of a prescribed medication, classified as controlled substance: Northbound Route 199 - On or about 8/23/01, a truck driver and co-worker/rider were injured when the driver of the 1993 Isuzu truck (GW 22,500 pounds) Maine commercial license plate 674-442, who was under the influence of a prescribed medication classified as a controlled substance, fell asleep while driving to their assignment. Among other methods, one feasible and acceptable abatement method correct this hazard is include into the existing employer's work place policy to ask for written medical documentation indicating work restrictions and back-to-work releases to prevent employees with medically affected performance from being assigned to vehicular operations.
