Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards created by improper material handling/hoisting of drums of wool soap: Basement - A hoisting device had been installed to lift 450 pound drums of wool soap into a cradle. The underhung, overhead hoist meets few if any of the ASME requirements found in B30.16-1998. There are no load ratings or markings on it, there are no latches on the hooks, periodic inspections had not been performed, the load was not attached to the load hook by a suitable means and the hoist was not attached to the ceiling by a suitable means. Among other methods, one feasible and acceptable abatement method to correct this hazard is to follow ASME B30.16-1998.
