Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and crushed-by hazards: On or about October 3, 2001, an employee at the workplace operating a Bobcat Skid Steer Loader, model 773, serial number 509649179, to load fertilizer was exposed to struck-by and crushed-by hazards. The employee was permitted to exit the operator's seat while the engine was running. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS: Provide information and training to employees on the proper operation of the Bobcat Skid Steer Loader in accordance with the Bobcat Skid Steer Operation and Maintenance Manual, including requiring "shut down" before leaving the operator's seat. 29 CFR 1903.19(d)(1) requires certification and documentation that the abatement of the above violation is complete.
