Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falls from work platforms elevated by powered industrial trucks: (a) Location - Warehouse: On or about 12/29/00, employees were elevated on four job-made work platforms using powered industrial trucks. Three were raised by high lift trucks where the operator remains on the ground and one was raised using an operator-up high lift truck, which was labeled it was not to be used for lifting personnel. The platforms were provided with guardrails that had not been adequately secured to the platform and did not extend around all sides. The platforms were not secured to the trucks. Among other means, one feasible means of abatement would be to: 1. Comply with all of the requirements of ANSI/ASME B56.1-1993, Safety Standard for Low Lift and High Lift Trucks, Sections 4.17 Elevating Personnel and 7.35 Platforms - Elevating. Which include, but are not limited to: a) providing a restraining means such as a guardrail or means for securing personnel such as a body belt and lanyard and where guardrails with entry gates or chains are provided, ensure that they are capable of withstanding a concentrated horizontal force of 200 lbs.; and b) providing a means to securely attach the platform to the lifting carriage or forks and to prevent the lifting carriage or forks from pivoting upward; and c) providing the weight of the platform, load capacity and the capacity of the truck needed to lift the platform with a determined load in a prominent location on the platform.
