Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of falling while riding in the bucket of a front end loader: (a) Location - 309/311 Lawrence Road, between driveways, Medford, MA: On or about May 2,2001, employee was exposed to a fall hazard of 12 feet, 6 inches into the excavation while riding the bucket of the Hitachi Excavator. Among other methods to correct this hazard include: 1. Develop and implement a comprehensive safety training program for employees on the use of heavy equipment. 2. Prohibit the practice of allowing employees to ride in the bucket of a front end loader.
