Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of delayed rescue while working in a confined space. (a) Location - Site: On or about 08/22/01, employer did not maintain communications with employees working in a 500 foot long section of water pipe, exposing employees to the hazard of delayed rescue in the event of an injury or illness. Among other means, Feasible means of abatement would be to institute a confined space entry program meeting the requirements of OSHA 1910.146 or ANSI Z117.1-1989. The program should include the use of 2 way communication devices such as radios or telephones which will work in a steel pipe line.
