Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of asphyxiation from oxygen deficiency or accumulations of toxic vapors/gases: (a) Location - Collier Ave. and Forest Street, Methuen, MA: On or about October 11, 2001, the employer had employees enter a sanitary sewer system manhole without air testing having been conducted to ensure that the confined space was safe to enter. Among other methods, feasible means of abatement would be to develop and implement a confined space entry program meeting the requirements of American National Standards Institute standard known as ANSI Z117.1-1989 or OSHA regulation 1910.146.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of delayed rescue and possible injury during entry into, work in, and exit from a confined space: (a) Location - Collier Ave. and Forest Street, Methuen, MA: On or about October 11, 2001, the employer had employees enter an approximately eight foot deep sanitary sewer system manhole without ensuring that non-entry emergency rescue and retrieval equipment was available and being used. Among other methods, feasible means of abatement would be to develop and implement a confined space entry program meeting the requirements of American National Standards Institute standard known as ANSI Z117.1-1989 or OSHA regulation 1910.146.
