Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of falling or being crushed while riding in the bucket of a Komatsu excavator. (a) Location - Putnam Street, North Beverly, MA: On or about 11/7/2001, an employee was exposed to the hazard of falling or being crushed while riding in the bucket of a Komatsu excavator. Among other means, Feasible means of abatement would be to; (1) Follow the manufacturer's instructions for use of equipment which prohibits employees from riding on the attachments used with the excavator.
