Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of: (a) Location - Warehouse: On or about 4/4/02, product racks full of pallets of frozen fish had damaged structural members. Feasible means of abatement to correct this hazard include, but are not limited to: 1(a). Institute a comprehensive rack inspection program to identify damage. 1(b). Unload product from damaged racks until repairs can be made as recommended by the rack manufacturer. 2. The installation of protective barriers around structurally sound racks to prevent damage to the rack system.
