Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck or crushed by the tractor trailer bed: (a) Location- East side of Parking lot: On or about 05/14/02, employees were exposed to the hazard of being struck or crushed by a tractor trailer bed falling from a job-made jack stand, consisting of a truck tire rim, and three separate, independent welded iron supports. Among other means, one feasible means of abatement would be to: 1. Perform an engineering review to determine the load rating of the jack stand prior to use to ensure it will hold the maximum expected weight to be placed on it. 2. Use a jack stand specifically designed to support a tractor trailer bed with storage material.
