Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being crushed or struck by the arm or the bucket of the 416c Backhoe Loader: (a) Location - Washington & Hodgkin Streets, Gloucester, MA: On or about 08/01/2002, an employee was exposed to the hazard of being crushed or struck by the arm or the bucket of a 416c backhoe loader. Among other methods, feasible means of abatement include (1) Follow the operation and maintenance manual which states all safety decals missing or damaged shall be replaced immediately.
