North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to skin and/or eye contact with injurious corrosive material contained in the LuPrep 43 55 gallon container they transported and connected to the wash system. a)cleaning tank: the eyewash facility located adjacent to the 55 gallon drum containing LuPrep 43 - iron phosphate with a pH of 1.8 - which is used to clean metal parts in an enclosed process, was dirty and had not been regularly tested as required by ANSI Z358.1-1990. Among other methods, one feasible and acceptable method to correct this hazard would be to clean the eye wash and place it on a periodic test schedule.
