North Carolina General Statute 95-129(1) of the Occupational Safety
and Health Act of North Carolina:  The employer did not furnish
each of his employees conditions of employment and a place of
employment free from recognized hazards that were causing or likely
to cause death or serious physical harm to employees in that
employees were exposed to:
a)facility, Murph building, throughout - Clark/Michigan
loader, model number 75GMC, serial number 495A21808, was
not provided with adequate braking for a safe stop.
Among other methods, one feasible and acceptable abatement
method to correct this hazard is to repair the brakes on the
machine when the brakes become worn and establish a preventive
maintenance program that focuses on the correction of safety
related items on mobile equipment.
b)facility, Murph building, throughout - Clark/Michigan
loader, model number 75GMC, serial number 495A21808, was
leaking hydraulic fluid and motor oil onto the machine
surfaces and floor.
Among other methods, one feasible and acceptable abatement
method to correct this hazard is to repair the leaks on the
machine and establish a preventive maintenance program to
correct leaks.
