North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of it's employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to bodily injury or death due to operational hazards of the point of operation not being guarded on the 9.0 meter Texo TM 200 loom. a)Weavexx - Dryer Weaving Room - a thorough hazard assessment of the facility, specifically the point of operation guarding on the looms in which employees would be expected to operate, was not conducted. Amoung other methods, one feasible and acceptable method to correct this hazard would be to conduct freqent hazard assessments, by a qualified and competent person, of the facility and specifically view guarding at the point of operation on machines which employees would be expected to operate.
