North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by motor vehicles. a)Intersection of Front and Edith Streets,No Traffic Control Plan (TCP) or Special Provisions were prepared by a person, who has been trained and is knowledgeable about the fundamental principles of temporary traffic control and work activities to be performed and followed, in areas that are effected by temporary traffic control zones. This responsibility would include the inspection of existing devices and conditions throughout the construction or maintenance project, for compliance with all applicable State and Federal Standards. One feasible and acceptable abatement method would be the preparation of a TCP and/or Special Provisions by an individual, who has been trained and is knowledgeable concerning the fundamental principles of temporary traffic control and work activities to be performed and followed, in areas that are effected by temporary traffic control zones. The responsibility would include the inspection of existing devices and conditions throughout the construction or maintenance project, for compliance with all applicable State and Federal Standards.
