North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to improperly operated machinery: a)site-the improper use of a John Deere model 5210 light duty tractor equipped with a 540 bucket loader attachment was used to move a felled tree which struck an employee and was the proximate cause of a fatality on 10/09/00. One feasible method of abatement is to provide proper equipment required for the job.
