North Carolina General Statute 95-129(1) of the Occupational Safety
and Health Act of North Carolina:  The employer did not furnish
each of his employees conditions of employment and a place of
employment free from recognized hazards that were causing or likely
to cause death or serious physical harm to employees in that
employees were exposed to:
1)Employer failed to provide adequate vehicles used to
transport workers.  Vehicles used to transport workers shall
have seats firmly secured ad adequate for the number of
employees to be carried.  Seat belts, seats, and anchorages
shall be provided in all transportation vehicles.  [Reference
49 CFR Part 571 Department of Transportation, Federal Motor
Vehicle Safety Standards].
Among other methods, one feasible and acceptable method of
abatement is to supply an enclosed passenger van type vehicle
for transport of all workers from work stations.
2) Employer required workers to stand on a moving work station
without proper hand holds or any restraining devices.
Employer had migrant farm workers standing on an open sided
trailer holding chicken brooders, washing machines, and other
assorted refuse on to trailer.  Migrant farm workers had no
hand holds, or restraining barriers such as standard railings
to ensure workers would not fall off the moving work surface.
One acceptable and feasible method of abatement is to secure
load with tie downs, bungee cords, or any other restraining
devices and transport workers only in approved and adequate
vehicles as noted in 1) above.
