North Carolina General Statute 95-129(1) of the Occupational Safety
and Health Act of North Carolina:  The employer did not furnish
each of his employees conditions of employment and a place of
employment free from recognized hazards that were causing or likely
to cause death or serious physical harm to employees in that
employees were exposed to a fall to a lower level:
Employees were accessing lower bays by climbing down into and out
of bays through open pit area, which was considered dangerous and
was in violation of company Safety Rules (ref. Lucor Standard
Operating Procedures, Chapter 2, Rule 2, page 27):
a)Bay 1, 2, and 3 - six employees were accessing lower
bays, (8 ft. drop to concrete floor, 5 ft. drop to metal
catwalk), by climbing down into pit area, onto catwalk,
on a daily basis for past 3 months.
One feasible and acceptable abatement method, among others, to
correct this hazard is to provide a portable ladder, with non-slip
base, lashed in place, for employees to access lower bay areas,
through pit openings.
