North Carolina General Statute 95-129(1) of the Occupational Safety
and Health Act of North Carolina:  The employer did not furnish to
each of his employees  conditions of employment and a place of
employment free from recognized hazards that were causing or likely
to cause death or serious physical harm to employees, in that
employees were exposed to vehicular traffic:
a)site, intersection of Lake Boone Trail and Redwoods Road,
middle of right lane - employee using Echo as-powered
leaf blower wearing dark blue clothing subject to
vehicular traffic was protected with bright, highly
visible clothing, barriers, speed reduction, use of
police, road closure or special devices.
One feasible method of abatement is to implement worker protection
systems of Part VI of the Manual on Uniform Traffic Control Devices
(MUTCD) 1988 Edition, Revision 4A, February 19, 1998.
