OSHA opens inspections for many reasons: routine scheduling under a national or local emphasis program, an employee complaint or referral, or a follow-up after a reported injury. North Carolina General Statute 95-129(1) of the Occupational Safety
and Health Act of North Carolina: The employer did not furnish
each of his employees conditions of employment and a place of
employment free from recognized hazards that were causing or likely
to cause death or serious physical harm to employees in that
employees were exposed to a fall to lower level and electrocution
hazard:
The employer did not address the Read & Heed ! warnings in the JLG
Lift Operation and Safety Handbook; 2) A malfunctioning lift shall
be shut down until repaired; 3) The controls shall be plainly
marked as to their function (ref. JLG Lift Operation and Safety
Handbook, page 1, no. 2, no. 3, Aug. 1, 1988):
a)yard - employees using JLG Lift, 40H, to perform trim
work on hull of dry-docked ferries, with malfunctioning
and illegible controls, while in boom basket, 20 feet
above concrete landing.
One feasible and acceptable method of abatement, among others, to
correct this hazard is to take the lift out of service and have it
repaired, before it can be used by employees.
