North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)workplace - boarding room - the employer operated a portable kerosene heater in an area approximately 18 inches from combustible pasteboard boxes where the operating instructions for the heater state that a 3 foot clearance must be provided. Among other methods, one feasible and acceptable method to correct this hazard is to operate the equipment in accordance with the operating instructions stamped on the side of the heater and in the owner's manual.
