NCGS 95-129(1): The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards which were likely to cause death or serious physical harm to employees. 1) Employer, Mrs. Eula Mills failed to protect employees from hazards that could possibly cause broken bones, shock, coma, burns or possible death, by requiring employees to ride in rear open bed of pick up truck. One reasonable way to abate among others which would be appropriate and feasible method of abatement is to install permanent seating and seat belts in open rear bed of trucks that are used for transportation purposes for workers.
