North Carolina General Statute 95-129(1) of the Occupational Safety
and Health Act of North Carolina:  The employer did not furnish to
each of his employees  conditions of employment and a place of
employment free from recognized hazards that were causing or likely
to cause death or serious physical harm to employees, in that a
hoist used to lift a door was not inspected, (Para 16-2.1.2, Para
16-2.1.3, ASME B30.16-1993; Section 10-1.3(a), ASME B30.10a-1996):
a)Schuler Press-a Budgit pneumatic hoist equipped with a
shank hook with latch, used to lift a steel door for
employees to access the interior of a Schuler F2-1600, 0-
800 Multi-Station Press, had not been inspected.
"ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD, AMONG
OTHERS, TO CORRECT THIS HAZARD IS TO CONTRACT WITH THE
ORIGINAL MANUFACTURER TO RETURN THE MACHINE TO IT'S
ORIGINAL CONDITION.

North Carolina General Statute 95-129(1) of the Occupational Safety
and Health Act of North Carolina:  The employer did not furnish to
each of his employees  conditions of employment and a place of
employment free from recognized hazards that were causing or likely
to cause death or serious physical harm to employees, in that
employees were exposed to an over loaded hoist, (Para 16-3.2.1,
ASME B30.16-1993; para 10-1.2.1.2(c)(3) & (4), ASME B30.10-1993):
a)Schuler Press-a shank hook in heavy service, used to
mount a 1/4 ton Budgit pneumatic hoist to an attachment
point, failed causing a 770 lb steel door of a Schuler
F2-1600, 0-800 Multi Stage Press to fall and strike an
employee on 01/08/00.
"ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD, AMONG
OTHERS, TO CORRECT THE HAZARD IS TO CONTRACT WITH THE
MANUFACTURER TO RETURN THE MACHINE TO IT'S ORIGINAL
CONDITION.

Adjustments, repairs, and replacements had not been done to a
hoist, (Para 16-2.3.3, ASME B30.16-1993):
a)Schuler Press-damaged and worn heavy service hooks and
load suspension components to a 1/4 ton Budgit had not
been replaced, nor was there a data plate or warning
label mounted on the frame of the hoist,IAW para 16-
2.3.3(d)(2), (5), and (8), ASME B30.16-1993; para 10-
1.2.1.2, 10-1.2.3 ASME B30.10-1993.
"ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD, AMONG
OTHERS, TO CORRECT THIS HAZARD IS TO CONTRACT WITH THE
ORIGINAL MANUFACTURER TO RETURN THE MACHINE TO IT'S
ORIGINAL CONDITION."

work/pass under the suspended load, (Para 16-1.3.3, ASME B30.16-
1993):
a)Schuler Press-employees were required to pass beneath a
steel door being supported by a Budgit hoist, to enter
the interior of a Schuler F2-1600, 0-800 Multi-Station
Press, to change die sets.
"ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD, AMONG
OTHERS, TO CORRECT THIS HAZARD IS TO CONTRACT WITH THE
ORIGINAL MANUFACTURER TO RETURN THE MACHINE TO IT'S
ORIGINAL CONDITION."
