North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)being struck by a falling boat in the event that the hoist system failed. The hoist in use at the facility was not load tested. Reference:ANSI B30.11-1980; paragraph 11-2.2.2(a) Rated Load Test - Prior to initial use, all equipment is to be tested.. NOTE:Among other methods, one feasible and acceptable means of abatement is to load test all crane as per ANSI B30.11.

The hoist in use at the facility was not inspected. Reference:ANSI B30.11-1980; paragraph 11-2.1.1 (a) Initial Inspection - before use, all new and altered cranes shall be inspected by a designated person. NOTE:Among other methods, one feasible and acceptable method is to inspect all cranes initially and the periodically as required.
