North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North
Carolina:  The employer did not furnish to each of his employees
conditions of employment and
a place of employment which were free from recognized hazards that were
causing or likely to
cause death or serious physical harm to employees in that employees were
exposed to:
a)being crushed by or caught between the CAT Dozer and the ground in the
event
of an overturn accident.  The employee operating the CAT Dozer, Model 953,
was grading the area adjacent to the building under construction while not
wearing the safety belt provided by the manufacturer of the equipment. The
grade
being worked on by this equipment was approximately a 30 degree grade.
Among other methods, one feasible and acceptable abatement method to
correct
this hazards is to train employees to wear the safety belt whenever they
are
operating the equipment and to enforce the wearing of the safety belt while
operating equipment with Roll over Protection Systems (ROPS) or a Fall On
Protection system (FOPS).
