North Carolina General Statue 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being crushed or caught under: a)warehouse - employees were not using the seat belts when operating powered industrial truck. One feasible and acceptable abatement method to correct this hazard is to enforce the seat belt requirement for employees who operate the powered industrial trucks in accordance with the operators manual and wear the seat belts in accordance with the operators manuals.
