North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North
Carolina:  The employer did not furnish to each of his employees
conditions of employment and
a place of employment which were free from recognized hazards that were
causing or likely to
cause death or serious physical harm to employees in that employees were
exposed to:
a)being struck by vehicular traffic.  Employee working in the right lane
of the
westbound lanes of the four lane Grandover Parkway at the intersection of
Club
Road on May 1, 2001 was not provided the protection of traffic control
devices
as prescribed in the Manual on Uniform Traffic Control Devices.
Feasible and acceptable means to correct this hazard include, but are not
limited
to:
(1)prohibiting  employees from working on the shoulder of, and in, roadways
where they are exposed to being struck by vehicular traffic unless they are
protected in their work zone by the use of uniform traffic control devices
as prescribed in the Manual on Uniform Traffic Control Devices specific
to the conditions the employees find themselves.
(2)provide adequate training to insure that employees understand the need
for
and use of appropriate traffic control devices.

exposed to moving vehicular traffic.

29 CFR 1910.132(a): Protective equipment was not used when necessary
whenever hazards
capable of causing injury and impairment were encountered.
b)being struck by vehicular traffic.  Employee working in the right lane
of the
westbound lanes of the four lane Grandover Parkway at the intersection of
Club
Road on May 1, 2001 was not adequately trained to insure that all safety
devices
and precautions were used specific to the conditions the employee was
exposed
to.
or in the alternative:
29 CFR 1910.132(f): The employer did not provide training to each employee
to insure there
understanding of, and need for, the use of personal protective equipment
in accordance with
paragraph (1)(i) and (1)(ii).
Feasible and acceptable means to correct this hazard include, but are not
limited
to:
(1)requiring and enforcing the wearing of safety vest of highly visible
material when employees are exposed to moving vehicular traffic.
(2)provide adequate training to insure that employees understand and use
required personal protective equipment.
