Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employees a place of employment which was free from recognized hazards that are likely to cause death or serious physical harm to employee in that employees were exposed to caught-in-between hazards which may result in serious injury or death. (a) Loading Dock - Paragraph 5.3.19 of American National Standards Institute (ANSI) B 56.1c 1991 (Safety Standard for Low Lift and High Lift trucks),employee was operating a Yale Forklift, serial number A509N02767T. Employee was not using seat belts/restraint devices to reduce entrapment of the operators head and torso between the fork lift and the ground in the event of a tipover.
