Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employees a place of employment which was free from recognized hazards that are likely to cause death or serious physical harm to employees, in that an employees was subjected to a crushing hazard while operating a power industrial truck (fork lift) which was not provided with a safety belt or other approved restraint system. (a) Clark Power Industrial Truck, Model C 500-55: Paragraph of the American National Standards Institute (ANSI) B 56.1d-1992 (Safety Standard for Low Lift and High Lift Trucks) requires all counterbalanced, center control, and high lift devices be equipped with seat belt/restraint devices or systems. A seat belt was not provided on a power industrial truck used to transport stacks of lumber.
