Section 5(a)(1) of the Occupational Safety and Health Act of 1970; The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or are likely to cause death or serious physical harm to employees in that employees were exposed to a caught-in between hazard while operating forklift trucks without wearing seat belts. (a) Loading Dock - Paragraph 5.3.19 of American National Standards Institute (ANSI) B 56.1c 1991 (Safety Standard for Low Lift and High Lift Trucks), employees, operating a Toyota Electric fork truck s/n 6hbw20-10385, were not using seat belts/restraint devices to reduce entrapment of the operator's head and/or torso between the fork lift and the ground in the event of a tipover.
