Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or are likely to cause death or serious physical harm to employees in that employees were exposed to a caught-in-between hazard while operating forklift trucks without wearing seat belts. (a) 1st Floor Warehouse - 1st Floor Warehouse - paragraph 5.3.19 of American national Standards Institute (ANSI) B 56.1c-1991 (Safety Standard for Low Lift and High lift Trucks), employees were not required to use seat belts/restraints devices to reduce entrapment of the operator's head and/or torso between the fork lift truck and the ground in the event of a tipover.
