Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being burned or seriously injured while working in an un-vented cold room: (a) Location - 320 Bent Street, Fourth Floor: On or about 7/15/02, employees were exposed to the hazard of being seriously injured by an explosion in an un-vented cold room (including but not limited to cold room #442), equipped with natural gas valves. Among other methods, one feasible and acceptable abatement method to correct this hazard is to provide ventilation consistent with NFPA 54, the National Fuel Gas Code, when gas valves are installed in a room.
