Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to:
Vehicular traffic while working in roadway repairing manholes.
"AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE
ABATEMENT METHOD TO CORRECT THIS HAZARD IS...."
To follow the American National Standards Institute(ANSI) D6.1-1971,
Manual on Uniform
Traffic Control Devices for Streets and Highways,Part 6C-12:
"The single most important element, within the system of traffic control
devices commonly used
in construction or maintenance areas (where a reduction in pavement width
is involved), is the
taper that is provided for the channelization.  An inadequate taper will
almost always produce
undesirable traffic operations with resulting congestion and possibly
accidents through the area.
A minimum desirable taper rate expressed as length in feet per for of
offset and
numerically equal to the 85 percentile speed is essential for smooth
traffic operations."
On July 3, 2001, Employees working around or in manhole in middle of the
street,
between 423-425 Mulberry Street, Baraboo, WI, traffic cones were placed
near manhole
rather than placed to taper lanes to redirect traffic, as required by ANSI
D6.1-1971,
section 6C-12.n
