Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Employees were exposed to struck by hazards associated with mechanical failure of the lift when employees rode the lift while it was being lowered. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS.... Comply with Automotive Lift Institute Standard for Automotive Lifts - Safety Requirements for Operation, Inspection and Maintenance. "ALI ALOIM-1994 4.4.2 The operator shall use all applicable safety features provided on the automotive lift, and operate the lift in accordance with the instructions furnished by the lift manufacturer." One of the safety instructions for the lift states: "Do no permit employees or customers on lift when it is either being raised or lowered."

Comply with the Automotive Lift Institute Standard for Automotive Lifts - Safety Requirements for Operation, Inspection and Maintenance. "ALI ALOIM-1994 5.1 Qualified Inspection Procedure: The owner or employer shall establish a periodic inspection procedure in accordance with the recommendations of the lift manufacturer in order to assure the continued safe operation of the lift."ion
