Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Hazards created by the use of elevated work platforms which were not used in accordance with the acceptable requirements of the American National Safety Standard for Rough Terrain Forklift Trucks, ASME B56.6-1992. A trained operator was not in position to control the rough terrain forklift. This condition existed when an employee was loading and/or unloading materials from the basket and no one was at the controls of the lift. Among other methods, one feasible and acceptable abatement method to correct this hazard is: To assure that the design, manufacture and use of all attachments for Rough Terrain Forklift Trucks are in accordance with the most current American National Standard, B56.6 (presently B56.6-1992), and/or has the prior approval of the lift truck manufacturer.
