Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees who were exposed to a crush hazard: On or about October 22, 2002, the tractor trailer utilized for shredded tire storage backed up in reverse without ensuring the area behind to the trailer was safe from employees walking within the area. Among other methods to prevent employees from hazards, one feasible and useful method is to: 1. Implement a strong and firm enforcement policy to prohibit employees from walking behind moving tractor trailers. 2. Provide effective training. 3. Provide a light or audible alarm to notify employees. 4. Utilize other useful engineering controls. 5. Comply with the construction OSHA Standard 29 CFR 1926.601.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees who were exposed to the hazard of fire and explosion from the ignition of combustible dusts generated by the Rasper 1 and Rasper 2 systems. Among other methods to prevent employees from hazards, one acceptable means of abatement would be to: 1. Ensure the ventilation equipment is adequate. 2. Change the knives on the Raspers more frequently. 3. Install a fire detection system as recommended by the manufacturer. 4. Comply with NFPA 654, Standard for the Prevention of Fire and Dust Explosions From the manufacturing, Processing, and Handling of Combustible Particulate Solids. 5. Comply with the manufacturer's guidelines for preventative maintenance.
