Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: On or about 10/29/02, employee(s) were working in a boom-supported elevated work platform without a personal fall arrest system. hazards created by the use of elevating work platforms which were not designed, constructed and/or used in accordance with the acceptable requirements of the American National Safety Standard for Boom-Supported Elevating Work Platforms, ANSI/SIA A92.5-1992. Section 8.8 (g) states: "Ensure all personnel in the platform are wearing fall protection devices and other safety gear as required at all times."
