Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were not required to wear restraint devices while operating forklift trucks. a) Yard Area - Employees who operate forklift trucks to lift marble slabs were not required to wear the restraint devices which were equipped on the truck. ABATEMENT NOTE: AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE MEANS TO CORRECT THIS HAZARD WOULD BE TO ENFORCE THE USE OF THE RESTRAINT DEVICES WHICH ARE EQUIPPED ON THE FORKLIFTS. NOTE: ABATEMENT CERTIFICATION REQUIREDATION
