MN Stat. 182.653 subd.2: The employer did not furnish to each employee, conditions of employment and a place of employment free from recognized hazards which caused or were likely to cause death or serious injury to employees; specifically: The lack of routine maintenance and repairs to the following DeBarco, 8000 lb. hoists in the shop area. The hazards of vehicles potentially falling and hoists sagging include, but area not limited to the following hoists: a) Five Debarco hoists (#1 and #4 north side, and #4,3,and 2 southside) which had warn, broken pivot pins and worn pin bushings, and missing arm pad pins. b) Four DeBarco hoists had packing leaks which caused unexpected lowering and sagging.
