MN Stat. 182.653 subd. 2: The employer did not furnish to each employee, conditions of employment and a place of employment free from recognized hazards which caused or were likely to cause death or serious injury to employees; specifically: Home made lifting devices were fabricated for use that were not certified with an approval rating from a qualified mechanical engineer and labeled with and identification tag on each unit that specified the rated capacity and identity of each unit as follows: a. Punch Press Area at steel rack where a six inch I- beam X 16 feet long was used with chains that were wrapped around the load block hook, beam, and bundles of steel, to lift them from delivery truck to steel rack. Bundles of steel weighed up to 4,000 pounds. b.Shipping Warehouse B where a four inch channel X 39 inches long with I- bolts and chain slings that were not alloy steel without a rating tag, were used to lift hydraulic press parts that weighed approximately 300 pounds.
