Title 40.1 - 51.1 (a), Code of Virginia: The employer, Booth and Co., Inc., did not furnish employment and a place of employment which were free from the recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: (a) At this site, approximately 29 protruding drive pins were uncapped in the area where the curb and gutter was being formed. In that particular area, about four to six employees were in close proximity of the drive pins at any given time. Most of the uncapped drive pins ranged in approximate height of eight inches to fifteen inches above the ground. "One feasible and acceptable abatement method, among others, to correct this hazard is to cap all the pins immediately after driving the pins into the ground."
