Title 40.1 - 51.1 (a), Code of Virginia: The employer, Dunnam and Dunnam, Inc., did not furnish employment and a place of employment which were free from the recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: (a) In multiple areas at this site, approximately 65 protruding drive pins were uncapped in the area where the curb and gutter had been formed. Approximately six employees were in close proximity of the drive pins at any given time. The uncapped drive pins ranged in height from one to seventeen inches above the ground. "One feasible and acceptable abatement method, among others, to correct this hazard is to cap all the pins immediately after driving the pins into the ground."
