General-duty citation text
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of falling from an overturning fork truck and being struck by the overhead structure. Employee operating the Mitsubishi fork lift truck was not wearing the seat belt that had been provided on the truck by the manufacturer. A feasilble method of abatement of this violation is to follow and enforce the manufacturer's recommendations in the owners manual which states "Wear you seat belt anytime you operate a fork lift truck".
